Bag Snob Trademark

It has come to our attention that certain people are using the name "bagsnob" or "bagsnobs" to sell goods online. Regardless of how fabulous the bags, they are certainly not the REAL Bag Snobs (meaning us). We have filed a trademark application for our name, Bag Snob, with the USPTO to prevent this type of confusion. We might give away our bags now and again, and that would be the only way you would get your hands on bags owned by the Bag Snobs!! =) We would hate for any of our readers to buy something thinking you were buying it from us. We want to avoid exactly this type of confusion. Thanks to our good friend Liezle for giving us the heads up!

    Even with a trademark .. If a person says " All you bagsnobs get a free lolipop with the purchase of your bag "

    but if they are saying its sold by the BagSnobs then that is a whole other story !

    Please explain , is this an ebay issue ? or just a language issue.
    Because people have been saying "BagSnobs" for years.

    WHAT KELLY MEANT IS THAT IF WE WERE TO RID OF OUR BAGS, WE WOULD GIVE IT AWAY, NOT SELL IT.

  • Anonymous, it's the difference between the use of a word as a trade mark (i.e. something that distinguishes the goods of one business from another) in the course of a business and use as a general descriptive term.

    If the ebay sellers were describing themselves or their goods as "BAG SNOB", then (in the UK at least) that would be trade mark infringement (if you had a registered trade mark) and passing off. Essentially, the sellers are trading off the reputation of this site to sell their merchandise and if Bag Snob LLC objects then it can stop it.

  • Yep. I've seen the name 'bagsnobs' more than once selling used designer bags at a major auction site. Although, it was quite obvious that the sellers were not the Bag Snobs that provide this wonderful site.
